Terms and Conditions of the Right of Withdrawal – LVS2 Digital Marketing Agency

  1. Right of withdrawal

As a consumer, you have the right to withdraw from the service contract within 14 calendar days of the date on which the contract was entered into, without having to give a reason and without incurring any penalty.

To exercise this right, you can submit a clear request via our https://lvs2.es/en/withdrawal-form/ or by any other legally valid means (email, letter, etc.). The request simply needs to be sent before the deadline expires.

  1. Exceptions to the right of withdrawal

In accordance with Article 103(a) of Royal Legislative Decree 1/2007, the right of withdrawal shall not apply if the service has commenced with your express consent before the end of the withdrawal period.

In LVS2, this applies in particular to the following services:

  1. a) Advertising campaigns

Once the planning, activation or execution of campaigns on platforms such as Google Ads, Meta Ads, LinkedIn Ads or others has begun, the service is deemed to have commenced. Express consent to launch the campaign implies the loss of the right to withdraw.

  1. b) Website design and development

The project is deemed to have commenced either from the kick-off meeting or from the handover of materials by the client. From that point onwards, the service is deemed to have commenced and it will no longer be possible to exercise the right of withdrawal.

Example of consent:

□ I agree that LVS2 may commence provision of the service before the end of the withdrawal period, and I acknowledge that this entails the loss of that right in accordance with Article 103(a) of Royal Decree-Law 1/2007.

  1. Consequences of withdrawal

If you exercise your right of withdrawal within the time limit and before the service has commenced, we will refund all payments made within a maximum of 14 natural days from receipt of your request.

The refund will be made via the same payment method used when you took out the policy, at no extra cost to you.

  1. Data protection

The personal data you provide to us in order to exercise your right of withdrawal will be processed solely for the purpose of handling your request, in accordance with the GDPR and the LOPDGDD. You can view our https://lvs2.es/en/privacy-policy/.

  1. Legislation and jurisdiction

These terms and conditions are governed by Spanish law. In the event of a dispute, both parties agree to submit to the courts of Madrid, unless the user is a consumer, in which case the courts of their place of residence shall have jurisdiction.
